These Terms of Service ("Terms") govern your use of our Store and the purchase of Ummy® Kids Superfood Shakes. By accessing or using our Store, you agree to be bound by these Terms. 1. About Us
Ummy® is a brand of Superfood Organics LLC dedicated to providing nutritious, kid-friendly superfood shakes designed for children ages 1 to 12. We aim to support health-conscious parents by offering products made with whole-food, organic ingredients to fuel strong bodies and sharp minds.
2. Permitted Use
You may use the Store to learn about Ummy® Kids Superfood Shakes, purchase our products for personal use, manage your account and subscriptions, and contact us with questions or feedback. The Store is intended for use by individuals 18 years or older. If you are a parent or guardian purchasing for a child, you represent that you have the authority to agree to these Terms on their behalf.
3. Prohibited Use
You may not use the Store for any illegal purpose or to harass, threaten, or harm others. You may not copy, sell, or distribute our content, images, or trademarks without permission. You may not attempt to hack, modify, or breach the Store's security systems, or misrepresent your identity or provide false information during purchases.
4. Product Purchases and Delivery
When you place an order, you agree to provide accurate payment and shipping information. We reserve the right to refuse or cancel orders due to pricing errors, stock issues, or suspected fraud. We aim to ship products promptly, but delivery times may vary based on location and external factors such as carrier delays. Tracking information will be provided when available.
4A. Use Guidelines for Toddlers
Ummy® Kids Superfood Shakes are made with clean, nutrient-rich ingredients suitable for children ages 1 and up. However, toddlers under 2 years of age may require smaller portion sizes due to their unique nutritional needs and the density of fiber, protein, and naturally occurring vitamins and minerals in each serving. We recommend parents consult with their pediatrician before serving Ummy® to children under age 2. If approved, a reduced portion of 2–4 oz per serving is generally suggested.
5. Subscriptions
When you subscribe to receive Ummy® products on a recurring basis, you authorize us to charge your payment method on the schedule you select. You may pause or cancel your subscription at any time from your account dashboard or by contacting us at ummyteam@ummyshakes.com. Cancellations must be made before the next billing date to avoid being charged for the next shipment.
6. Refunds and Returns
All sales are final due to the perishable nature of our products. If your order arrives damaged, defective, or incorrect, please contact us within 7 days of delivery at ummyteam@ummyshakes.com with your order number and a photo of the issue. We will make it right with a refund or replacement at our discretion. See our full Refund Policy for details.
7. Intellectual Property
All content on this Store — including illustrations, character designs, logos, product descriptions, videos, and branded materials — is the property of Superfood Organics LLC (dba Ummy®) and is protected by U.S. and international copyright, trademark, and intellectual property laws. This includes original characters from the Ummy® Kids universe such as Bernie the Bear™, Lucy the Llama™, Marley the Monkey™, and Professor Hoot™, as well as the story world Evergreen Valley™. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
8. Privacy and Cookies
Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information. We use cookies to enhance your experience. Information you provide is confidential and will not be shared with third parties except as needed to process orders or as required by law.
9. Disclaimer of Liability
You agree to indemnify and hold Ummy® harmless from any claims, damages, or losses arising from your misuse of the Store or violation of these Terms. We are not liable for indirect, incidental, or consequential damages related to your use of the Store or products, to the fullest extent permitted by law. Our products are provided "as is" and while we strive for quality, we do not guarantee specific health outcomes.
10. Choice of Law
These Terms are governed by the laws of the State of California. Any disputes will be resolved under California law, and you agree to submit to the jurisdiction of California courts. We may also opt for arbitration at our discretion.
